Stop violences

Acts of violence, discrimination, bullying and sexual harassment; racist and anti-Semitic acts; LGBTQIA+phobia and sexist behaviour – the fight against these forms of violence is a priority for ENSICAEN.

As in all higher education and research establishments, the management and supervisory staff are aware that neither staff nor students are immune to these problems. The school’s action is multifaceted: training, prevention, awareness-raising, communication, and support for victims. ENSICAEN is also committed to punishing all types of violence in order to guarantee a safe and inclusive environment for all.

Awareness-raising and prevention initiatives are carried out as part of the Inédi project. Launched in September 2022, the consortium brings together several higher education establishments in Caen to create a shared culture of Inclusion, Equality and Diversity.

It is our collective responsibility to make the principle of ‘zero tolerance’ a reality.

Every user and every member of staff at ENSICAEN must behave in an exemplary manner and report any act of violence that he or she witnesses, in order to help the management team combat these scourges.

Freeing people to speak out and support victims

ENSICAEN reporting systems

To inform, support, guide and protect victims and witnesses, as well as punish the perpetrators of violence, ENSICAEN has set up an online system for collecting and processing reports*  available 24/7.

Anyone, whether a witness or a victim, can report any information they are aware of via this dedicated alert system or by any other means they deem necessary. Confidentiality is guaranteed throughout the collection and processing procedure.

* An alert is not a complaint. The reporting system is not an emergency platform and will never replace the local and national authorities. For all emergencies, contact the national emergency numbers.

Counsellors

Counsellors are also available to students and members of staff. Subject to obligations of confidentiality, neutrality and impartiality, the counsellors offer support, guidance and protection to victims and witnesses, and inform them of the action to be taken in response to their report.

ENSICAEN’s trustworthy students

Every year, students volunteer to ensure a calm and caring environment and to listen to all students. They take it in turns to be present at all student life events and wear a fluorescent yellow armband to make them easily recognisable! Disciplinary procedure

In the event of proven misconduct, the student(s) concerned will be called before a disciplinary committee. The members of the disciplinary section are responsible for taking decisions relating to disciplinary offences. Measures may range from a warning to exclusion from the establishment.

The Director may also file a report with the Public Prosecutor under article 40 of the Code of Criminal Procedure.

Disciplinary proceedings may be initiated against a member of staff if his or her behaviour is incompatible with the performance of his or her duties and/or the dignity of the position. Penalties for civil servants other than teachers range from a warning to dismissal, and for teachers from a call to order to a permanent ban from teaching or research in any public higher education establishment.

Fight against racism, anti-Semitism and all forms of discrimination

Attentive to the values of inclusion and tolerance, ENSICAEN strongly condemns acts of racism, anti-Semitism and all other forms of discrimination: unequal treatment, people belittled or attacked verbally or physically because of their actual or supposed membership or non-membership of a particular ethnic group, nation, alleged race or religion.

Racism, anti-Semitism and discrimination may give rise to criminal proceedings.

Insults, defamation or incitement to discrimination, hatred or racial violence are punishable by a fine of between 1,500 and 45,000 euros and 1 year’s imprisonment, depending on whether they are made in public. Racial discrimination is punishable by a fine of 45,000 euros and 3 years’ imprisonment, apology for crimes against humanity by a fine of 45,000 euros and 5 years’ imprisonment, and harassment by up to 75,000 euros and 5 years’ imprisonment. Physical violence is punishable by 3 years’ imprisonment and a €45,000 fine, up to life imprisonment.

Combating sexist and sexual violence and LGBTQIA+phobia

ENSICAEN is committed to promoting an inclusive environment that respects people, regardless of their sex, sexual orientation, gender identity or gender expression. The aim is to raise awareness, intervene, protect and prevent situations of violence, moral harassment and acts committed on the grounds of gender, sexual orientation or gender identity.

Gender-based and sexual violence can give rise to criminal proceedings.

Sexist contempt is punishable by a fine of €1,500, sexual harassment by 2 to 3 years’ imprisonment and a fine of €30,000 to €45,000. Sexual assault can be punishable by 5 to 7 years’ imprisonment and a fine of €75,000 to €100,000, and rape by 15 years’ imprisonment.

It is crucial to always ask your partner for explicit consent before engaging in any sexual activity. Under no circumstances should consent be presumed, particularly if the person is under the influence of drugs or alcohol, or if they are in a vulnerable situation due to their state of health.

Consent must be given in a free and informed manner, without pressure or coercion. Respecting these principles is essential to ensure respectful and equal relationships.

Hazing

Hazing, in all its forms, is strictly prohibited by law. It undermines personal dignity and is an offence defined in article 225-15 of the French Criminal Code. All humiliating, degrading and even violent practices that undermine the physical and moral integrity of students are strictly prohibited at ENSICAEN. Consent, an essential concept, can under no circumstances justify such behaviour.
